The first document that started our countrys journey through federalism, was the Declaration of Independence on July 4, 1776. Although its heading was not to design a new government, the ideas it that it focused on became the base for the Constitution of the United States (Patterson 42). The Declaration of Independence found (amongst other things) sovereign states. With this new development there was a need for organization of the states and Congress was established by the Articles of the compact in 1781. The Articles, while flawed, were the first attempt to state of ward what we eventually called Federalism.
There were a few major flaws in the Articles that ultimately caused its failure. The two most prevalent flaws were that the national government didnt sop up the power to tax or to regulate interstate medico (Remington 5).
The states still had the freedom to put their interests above those of the nation. In post-Revolutionary war America, it was the lack of economic unity that caused the Articles to fall apart. Because Congress didnt have the power to enforce taxes to respond to the post-war debt, people revolted. sodbusters, led by Daniel Shay marched on Massachusetts courthouses in response to foreclosures on their land. Shays Rebellion compete a major role in displaying that Congress was weakness and that Civil unrest was spreading (Patterson 45).
